In a move that surprised no one, the liberal-dominated Supreme Court handed a victory to the Biden administration by ruling that Texas and Louisiana lacked standing to challenge the Department of Homeland Security’s “Guidelines for the Enforcement of Civil Immigration Law.” These guidelines prioritized the arrest and removal of illegal immigrants who met specific criteria such as being suspected terrorists or dangerous criminals and those who recently entered the country illegally. Texas and Louisiana argued that this policy violated federal law and would have required them to “incur costs due to the Executive’s failure to comply.”
Despite a lower court agreeing with the two brave states, the Supreme Court dismissed the case in an 8-1 decision in United States v. Texas. Justice Brett Kavanaugh, writing for the majority, called the lawsuit an “extraordinarily unusual” attempt to force the Executive Branch to make more arrests. The majority opinion stated that “Federal courts have not traditionally entertained that kind of lawsuit.” Kavanaugh essentially said that the states had no standing to sue because they were not the ones being threatened with prosecution or harm.
Justice Neil Gorsuch filed a concurring opinion, which also made it clear that the states lacked standing, but he joined by Justices Clarence Thomas and Amy Coney Barrett. Justice Barrett also filed a concurring opinion joined by Justice Gorsuch. Justice Samuel Alito was the only dissenter and warned against the far-reaching powers granted to the Executive Branch.
The Supreme Court’s ruling made it clear that Congress has an array of tools to hold the Executive Branch accountable. These include oversight, appropriations, the legislative process, and Senate confirmations. However, the court’s decision should not be read to suggest that the Executive Branch possesses a freestanding or general constitutional authority to disregard statutes requiring or prohibiting executive action.

Conservatives everywhere should be outraged by this left-wing Supreme Court decision. With their refusal to hear this case, they are allowing the Biden administration to continue its open borders policies and putting American lives at risk. Thankfully, we have brave states like Texas and Louisiana who are standing up to the Biden administration and fighting for the rule of law. The only way to hold elected officials accountable for their actions is to get out and vote. Remember this decision when you head to the polls next November. The fate of our nation hangs in the balance.
