Former Special Counsel Hur discovered the documents in his basement; they were determined to be extremely classified and pertinent to contemporary national security concerns. Rep. Waltz has requested that the Intelligence Community conduct an immediate damage assessment.

Former Special Counsel Robert Hur determined that Biden mishandled classified information during the investigation; however, he was not prosecuted on these charges on the grounds of his mental fitness and the potential for an appeal to a sympathetic jury. The inquiry unveiled indications that Biden intentionally retained and disclosed classified materials subsequent to his tenure as a private citizen following his vice presidency. The materials in question comprised designated classified documents pertaining to Afghanistan's military and foreign policy, in addition to notebooks that contained handwritten entries concerning matters of national security and foreign policy that involved sensitive intelligence sources and methods. The aforementioned materials were retrieved from the basement den, offices, and garage of Biden's residence in Wilmington, Delaware.

Biden would likely present himself to the juror as a sympathetic, well-intentioned elderly man with a poor memory, according to the investigation. Based on their interactions with him, the report indicates that it would be challenging to persuade a jury to find him guilty of a severe felony that requires a mental state of willfulness.
