The Daily Mail reported that, in response to escalating criticism, the DOJ is contemplating delaying the plea agreement. This comes after The Heritage Foundation, a conservative charity, filed a lawsuit against the Justice Department for refusing to release David Weiss's communication records. The Foundation's lawsuit disclosed a phone conversation between the Foundation's attorney and DOJ counsel Jason Lynch, during which Lynch allegedly made a significant admission. The attorney suggested requesting a postponement of Hunter's plea hearing to enable for the publication of Weiss' records.

The Foundation is looking for evidence to support the claims of the whistleblowers that Weiss was prevented from prosecuting Hunter's crimes in other jurisdictions due to prosecutors appointed by Biden. While Attorney General Garland stated that Weiss had the authority to prosecute Hunter anywhere in the United States, IRS agents testified before Congress that Weiss claimed Biden-appointed prosecutors prevented him from pursuing felony tax charges.

The Department of Justice has stated that they will endeavor to produce some documents, but nothing will be disclosed until after Hunter's plea hearing. It is feared that allowing Hunter to plead guilty to misdemeanor offenses with no jail time amounts to a "backdoor pardon." The Foundation believes there is a pattern of unethical business dealings by the Biden family, and that the plea agreement is another example.
