The U.S. Court of Appeals for the Fifth Circuit issued an injunction on Tuesday, stating that the wire can only be cut in the case of a medical emergency while Texas’s appeal is being processed. The court ruled in favor of Texas, asserting that the federal government should keep its hands off state property and that property rights should be protected from government intrusion and control.
The 29 miles of wire strung along the border is part of Texas’s multi-phase effort to deter illegal immigration. Governor Greg Abbott has emphasized the necessity of these measures due to President Biden’s open-border policies. Abbott recently signed a law making crossing the border illegally a state crime, with penalties including jail time unless the illegal immigrants agree to immediately return to Mexico.
Texas has been left to fend for itself due to the “deliberate inaction” of the Biden administration, according to Abbott. He believes that the federal government’s lack of action has forced Texas to take matters into its own hands to protect its borders.
