Circuit, predictably split along ideological lines. It seems some judges are more interested in playing politics than serving justice.
Trump-appointed judges Katsas and Rao emphasized that the pause on Boasberg’s contempt proceedings wasn’t a pass for the administration. Instead, it was a call for sanity, giving the court time to actually consider the appeal. Yet, predictably, a liberal judge dissented, clinging to her Obama-era ideological framework. Shocker.
And what triggered this? Judge Boasberg accused the White House of ignoring his verbal order to return alleged gang members, members of the infamous Tren de Aragua, to El Salvador. In Trump style, the administration aimed to swiftly remove these foreign criminals under the Alien Enemies Act, a logical move to protect American citizens. But surprise, surprise—the Supreme Court issued a pause, stepping on the administration’s efforts to defend our borders.

Boasberg even floated the idea of hiring a private attorney if the Department of Justice doesn’t play his game. Why? Because the DOJ, quite possibly, can’t find anything worth prosecuting. Renowned attorney Alan Dershowitz laughed off the likelihood of any real consequences, confident the blustering judge will be overruled on appeal. The vague order in question screams overreach rather than sound jurisprudence.
