He is prosecuting the former president under the Espionage Act of 1917, alleging that Trump unlawfully took classified documents from the White House after leaving office. However, President Trump has consistently maintained that he had the right to declassify any documents in his possession under the Presidential Records Act. Smith’s flimsy case is crumbling, and the chances of it being thrown out are becoming increasingly likely.
To make matters worse for Smith, President Trump’s attorney, Alina Habba, is threatening to expose bias within Smith’s team. She plans to conduct depositions to uncover any potential misconduct in the case. For instance, she has pointed to orders from FBI officers who, during the raid on Mar-a-Lago, instructed the staff to turn off security cameras.
