The driving force behind Biden’s proposal seems painfully clear. Now that the Supreme Court is solidly conservative with a 6-3 majority, many Democrats recognize that their ambitions for sweeping progressive changes are stymied. Rather than dealing with this reality, Biden appears to be throwing a tantrum, hoping to reshape the court to serve his agenda. Recent rulings, including those that restricted federal overreach and protected states’ rights, have exposed the weakness of Biden’s position. The Dobbs decision alone, which clarified that abortion is not a constitutional right, sent shockwaves through the Democratic base, prompting a flurry of frustration directed at the Supreme Court.
