DOJ Finds UC Berkeley Discriminated Against Whites, Asians

The Department of Justice’s Civil Rights Division has officially concluded that the University of California, Berkeley School of Law illegally discriminated against white and Asian applicants in its 2024 and 2025 admissions cycles, a damning finding that should shock every American who believes in fairness under the law. Assistant Attorney General Harmeet K. Dhillon signed the department’s findings letter, laying out clear evidence that the law school’s practices violated Title VI and flouted the Supreme Court’s Students for Fair Admissions decision.

The data the DOJ analyzed is stark and unmistakable: in 2024 a Black applicant had 6.5 times the odds of admission compared with a comparable white applicant, and in 2025 that advantage was 5.8 times — disparities large enough to demolish any claim of coincidence or benign intent. Median LSAT scores for admitted Black students lagged materially behind their white and Asian peers, underscoring that race, not merit, was driving outcomes.

Berkeley’s dean was recorded discussing “proxies for race” and even “unstated affirmative action,” and the school’s own application prompts solicited identity-based information and grouped students by “primary identity,” tactics the DOJ says were used to mask race-conscious decisionmaking. This isn’t nuance or academic legerdemain; it’s a deliberate system designed to prioritize identity over qualifications, and the department’s letter leaves little room for plausible deniability.

Conservatives who have long warned that DEI bureaucracies would hollow out standards and privilege identity over achievement should feel vindicated by this enforcement action, and patriotic Americans should applaud Dhillon’s Civil Rights Division for doing its job. The DOJ has made clear it will attempt a voluntary resolution to bring Berkeley into compliance, and if those negotiations fail the department is prepared to use the full force of the law — including litigation — to protect applicants’ civil rights.

Let there be no mistake: this is about more than a law school. It is about whether our institutions will be governed by the rule of law or by fashionable ideology that rewards identity at the expense of competence. If universities continue to flout federal law while hoarding taxpayer dollars and prestige, conservative voters and elected officials must demand accountability, from funding remedies to personnel consequences.

UC Berkeley’s initial pushback — predictable handwringing about “diversity” and reputational posturing — cannot erase documented evidence laid out by federal investigators. The DOJ’s findings should trigger a nationwide reckoning at elite institutions: either end covert race-based schemes, or face the prospect of federal enforcement tearing them down.

Patriotic Americans who value opportunity for every child, regardless of zip code or political fashion, should stand up now and insist that admissions be judged on merit and character, not curated demographic engineering. The rule of law has been reaffirmed today, and conservatives will hold the line until every college and university respects equal treatment under the law.
