Senators finally forced a showdown this week, and Dr. Anthony Fauci chose to invoke the Fifth Amendment rather than answer direct questions about the pandemic failures that cost Americans dearly. That refusal didn’t come in a vacuum — Republicans have spent years demanding transparency, and Fauci’s silence only fuels the suspicion that the permanent administrative class still won’t be held to account.
What makes Fauci’s silence especially galling to patriots is that President Biden had already granted him a full, preemptive pardon in January 2025, an act that looks conspicuously like political cover for a top bureaucrat. Americans deserve to know whether that pardon was an act of mercy or a political shield designed to hide mistakes and shield allied officials from scrutiny.
Conservative legal advocates like Mike Davis of the Article III Project have been outspoken on shows like Megyn Kelly’s about how the establishment’s favored figures shouldn’t be allowed to vanish behind legal maneuvers. Davis and others are right to push back: a pardon shouldn’t become a license for silence when millions want answers about school closures, economic ruin, and infringed liberties.
There are real, lawful tools Congress can — and must — use to compel testimony, from contempt citations to court-enforced subpoenas and even the grant of immunity where appropriate so witnesses can be compelled to talk. The history of congressional enforcement and federal immunity statutes makes clear that a committee determined to get the truth can take the necessary steps to break through evasions.
None of this should be a partisan stunt; it’s about restoring basic accountability and reminding our institutions that no one is above the people they serve. If Democrats think a last-minute pardon frees their allies from public scrutiny, they’ve misread the resolve of Americans who want transparent government and consequences for bad policy.
Patriots should demand that Republican leaders follow through — not just with bluster but with legal muscle — to make sure witnesses testify under oath and under threat of penalty if they refuse. Our republic doesn’t survive on secrecy and pardon-by-politics; it survives when elected officials answer for their decisions, and when the law is applied even-handedly to those who once told us they were protecting our health.
