Illegal Alien Evades Justice, Cries “Disability” to Dodge the Law

An illegal immigrant who is facing charges for the death of a St. Johns County, Florida, sheriff’s office sergeant is now making audacious claims in a federal civil rights lawsuit. The 19-year-old illegal alien, Virgilio Aguilar-Mendez, hailing from Guatemala, is attempting to evade responsibility for his actions by asserting that his limited English-speaking skills render him disabled under the “Americans with Disabilities Act” and the “Rehabilitation Act.” Can you believe the nerve of this guy?

Aguilar-Mendez’s defense team has filed a lawsuit against the late Sgt. Michael Kunovich’s estate, along with Lt. Jose Jimenez and St. Johns County, alleging that their client’s inability to speak English or Spanish constitutes a disability. They’re arguing that he was deprived of his rights because he wasn’t provided with an interpreter at the scene and at the Sheriff’s Office to understand his Miranda rights before Jimenez interrogated him. What a load of hogwash!

In a true display of chutzpah, Aguilar-Mendez’s attorneys have also accused the law enforcement officers of racism and police brutality, claiming that their client was a victim of racial profiling and constitutional rights violations. Give us a break! The nerve of these lawyers to fabricate such outrageous accusations in an attempt to discredit law enforcement officers who risk their lives to keep our communities safe.

Let’s not forget the circumstances that led to Kunovich’s tragic death. Aguilar-Mendez resisted a lawful pat-down by attempting to flee and then continued to resist when other officers got involved. After a prolonged struggle, during which Aguilar-Mendez attempted to grab the officer’s taser and pulled out a pocketknife, Kunovich collapsed and later died despite lifesaving efforts. This illegal immigrant’s reckless and violent actions directly led to the death of a dedicated law enforcement officer.

To top it off, Aguilar-Mendez is not even in the United States legally. He arrived at the border in 2023 and was released into the country. His attorney claims he had been working on a farm and sending money back to Guatemala. So, not only did he break the law by entering the country illegally, but he also now has the audacity to file a baseless lawsuit and try to shift blame for his own actions onto law enforcement officers. It’s preposterous!

In the midst of this tragedy, it is essential to focus on honoring the memory of Sgt. Kunovich and supporting his family, rather than entertaining the absurd claims of an illegal immigrant who is desperately trying to evade accountability. It’s time to stand up for our law enforcement officers and uphold the rule of law, rather than entertaining these ridiculous claims by a law-breaking individual. This lawsuit is a prime example of the lengths some will go to in order to avoid facing the consequences of their actions.
