Ted Cruz Leads the GOP in Filing an Amicus Brief Supporting the Second Amendment and Individual Rights

Senator Ted Cruz of Texas is leading a group of fellow Republicans who have filed an amicus brief with the United States Court of Appeals urging the First Circuit to support the Second Amendment and the rights of Americans. The brief focuses on the Estados Unidos Mexicanos v. Smith & Wesson Brands, Inc. case; in 2021, Mexico filed a lawsuit in the District of Massachusetts against gun manufacturers in the U.S., alleging that the Mexican people have been "victimized by a deadly flood of military-style and other particularly lethal guns that flows from the U.S. across the border, into criminal hands in Mexico."

Cruz and his fellow Republicans, including Senators Rick Scott of Florida, Ted Budd of North Carolina, Marsha Blackburn of Tennessee, and thirty-five House Republicans, stated that the lawsuit lacks merit. This was a substantial reason why it was discarded in September 2022. Currently, the Mexican government is contesting that decision.

"Mexico's arguments in this litigation lack merit, which is why the district court dismissed the case last year. In conclusion, the Mexican government is attempting to impose its own interpretation of American law on American enterprises. This demonstrates a disregard for our Constitution and the Second Amendment in particular," Cruz told the Daily Caller after obtaining a copy of the brief prior to filing the amicus brief.

In addition, Cruz emphasizes that Mexico "ignores the fact that Congress exercised its authority by passing the relevant law, the Protection of Lawful Commerce in Arms Act (PLCAA), and that the United States is a sovereign nation." The brief then defends the PLCAA, a federal law that shields businesses that sell firearms from liability for damage caused by criminals who misuse those firearms.

It is fortunate that Ted Cruz and his Republican colleagues are defending the Second Amendment and the rights of Americans. Mexico appears to be attempting to impose its will and interpretation of American law on American enterprises, in defiance of American sovereignty and the Second Amendment. The PLCAA is a crucial federal statute that protects businesses that sell firearms and prevents them from being held liable for the criminal actions of individuals who misuse them.
