In response to the growing number of controversies involving the Department of Education's decision to require schools to adopt diversity and inclusion policies, Florida Senator Marco Rubio has proposed legislation that would restrict how race is considered when it comes to assessing the accreditation of institutions. The bill aims to protect free speech and prevent the department from interfering with the operations of colleges.
A proposed bill would prevent accrediting agencies from considering a university's use of race as a factor in its admissions process. Instead, they would require educational institutions to demonstrate how they ensure that students have the right to free inquiry. This legislation would provide much-needed accountability for universities and colleges.
This legislation was introduced in response to the Supreme Court's ruling on the legality of affirmative action in Harvard University's and the University of North Carolina's admissions practices. Students For Fair Admissions has claimed that both universities use race as a factor in their admissions process.

Other prominent Republican politicians, such as Mike Lee and Rick Scott, have supported the bill. They believe that it will help promote excellence in education by protecting the free exchange of opinions on campus. In addition, it requires educational institutions to be evaluated by accrediting agencies to ensure that they follow the First Amendment.
The bill would also prevent universities from implementing discriminatory and divisive diversity and inclusion policies. It is important that policymakers hold institutions accountable as the country moves toward improving higher education's equity and fairness.
