As the story of Hunter Biden’s potential gun charges on drug-related grounds continues to develop, it appears that the First Son is relying heavily on one of the most ironic legal arguments possible: using Second Amendment case law to defend himself.
According to recent reports, Hunter Biden’s legal team has allegedly reached out to DOJ officials to let them know that they intend to challenge any charges on Second Amendment grounds. Specifically, they’re expected to point to a Supreme Court ruling from last year that greatly expanded protections for Second Amendment rights.

If charges are filed, they would likely stem from allegations of Hunter Biden lying on documents related to his firearm purchase. Specifically, he allegedly claimed that he wasn’t an “unlawful user of… any controlled substance”. However, his 2021 memoir apparently contradicted that claim by admitting that he was “smoking crack every 15 minutes” at the time of the purchase, potentially making him ineligible to own the firearm.
While the Gun Control Act of 1968 is quite clear on the matter of drug users not being able to obtain firearms legally, Hunter Biden’s legal team is hoping to take advantage of the somewhat ambiguous case law in this area. While many courts have upheld provisions against drug users owning firearms, some have been more lenient in their interpretation.
In the end, it’s anyone’s guess whether Hunter Biden’s legal gambit will work. But while it might be strange indeed to see a member of the Biden family relying on Second Amendment arguments, it’s also worth remembering that this may be a way for the troubled First Son to deflect attention from more serious ongoing investigations into his lobbying activities on behalf of foreign companies. Only time will tell.
